What is meant by the land register?
Properties and property-related rights (e.g. building rights) are considered immovable assets within the meaning of Section 285 of the Austrian Civil Code (ABGB) and represent defined parts of the earth’s surface. They are registered in the Austrian land register.
Under Austrian brokerage law, an exclusive agency agreement is a contract in which a client agrees to appoint only one real estate agent to handle the sale or rental of a property for a specified period of time (§ 14 Austrian Real Estate Brokers Act – MaklerG).
The costs of transferring a property as a gift depend primarily on the value of the property as well as on the specific structure and terms of the transfer.
What should be considered when inheriting a property?
The inheritance of a property is handled as part of probate proceedings. Ownership of the property is transferred to the heirs either through statutory succession or on the basis of a will.
